What is an “eSeal” ?

A Legal Entity’s electronic seal (e.g for organizations, companies) is a digital signature attached in a digital document (e.g. pdf) that secures the origin of the signatory and the integrity of the document. Like its handwritten counterpart in the offline world, an electronic seal is a legal concept capturing the signatory’s intent to be bound by the terms of the signed document.

What is it used for?

Use your eSeal to digitally stamp your organization’s documents (e.g. pdf documents) and secure the authenticity and integrity of their content. Here are some examples on how you can apply an electronic seal:

  • In small or large number of digital documents in order to secure the origin and integrity (legal documents, electronic invoices, certifications, letters, etc)
  • In electronic files, to prove their existence at a particular time instance (log files, financial reports, notices, etc)
  • For hard proof of legal representation, in combination with an eSignature from the organization’s legal representative
  • In digital files (e.g. pictures for which you own Intellectual Property Rights) so that ownership information is always visible and available

HARICA offers two types of electronic signatures compliant with the EU Regulation 910/2014 (eIDAS):

Advanced Electronic Seal

An electronic seal that is:

  • uniquely linked to and capable of identifying the signatory as a Legal Entity
  • created in a way that allows the signatory to retain control
  • linked to the document in a way that any subsequent change of the data is detectable

Qualified Electronic Seal

An advanced electronic seal which is additionally:

  • created by a qualified signature creation device
  • and is based on a qualified certificate for electronic seal

While different levels of electronic seal may be appropriate in different contexts, only “qualified” electronic seals are explicitly recognized to have the equivalent legal effect of “traditional” seals in every member of the European Union.

*QSCDs come in many forms to protect the electronic signature creation data of the signatory, such as smartcards, SIM cards, USB sticks. “Remote signature creation devices” can also be used where the device is not in the physical possession of the signatory, but managed or supervised by a Qualified Trust Service Provider.
